Terms and conditions 


USAGE RIGHTS AND OWNERSHIP:

Client acknowledges that Photographer is the Author of the Image(s) and also the first and sole owner of all copyrights of the Image(s). The Image(s) and all copyrights remain the exclusive property of the Photographer without limitation. All usage rights to the Image(s) specifically granted by the Photographer to the Client appear on the reverse side of this Agreement. 

IMAGES ARE LICENSED FOR SPECIFIC USE(S) AND ARE NOT SOLD.

Client understands and agrees that it is not buying the Image(s) but is paying only for a license to use the Image(s) as specified in this Agreement. Note that buying the Image(s) copyright will always be much more expensive than any licensing fee.
The license term begins when the Photographer receives full payment of the invoice and upon delivery of images.
Unless otherwise agreed, any rights granted are always non-exclusive, non-sub-licensable, and non-transferable. Any Image(s) may not be used in a logo, corporate identity, trademark, or other service mark.
The use of any Image(s) by the Client will not constitute a work of joint authorship.
Copyright metadata contained within any digital file may not be altered, or removed, without the express consent of the Photographer.
Unless otherwise agreed, the Photographer retains the right to use the Image(s) for his self-promotion.








PHOTOGRAPHIC INTEGRITY AND ALTERATIONS:

The client will not make or permit any alterations, including, but not limited to, filters, additions, subtractions, or adaptations, concerning the Image(s), alone or with any other material, without the prior express permission of the Photographer.  



Portrait sessions include editing which consists of changes to the color, crop, contrast, & exposure at the photographer’s discretion.  Portrait sessions do not include retouching.  Boudoir sessions include retouching done at the photographer's discretion. 






Booking/Cancelation Policy


BOOKING POLICY: For all regular sessions 50% of the package price 
non-refundable session retainer is required to book and hold the date for your session and serves as a cancellation fee. However, the fee can be credited towards a future session. The remaining balance is due before the session date.

CANCELLATION POLICY: The client forfeits their
session retainer paid to book the session. As
previously stated, the fee can be credited
towards a future session if the client reschedules
the appointment by calling 72 hours before the
date of session and re-booking at an agreeable
date and time.




Punctuality Policy: It is strongly recommended that you plan to arrive at least 10-15 minutes early to account for any transportation issues, wardrobe changes, prep time, etc. Please come with hair and make-up ready. If you are running late, please get in touch with us immediately. If you are 10 minutes late you will be charged a $20 penalty. If you are 20 minutes late, you will
be charged a $50 penalty. After more than 30 minutes late with no contact you will forfeit your booking fee and your session will be canceled.
Refusal to pay late penalties will result in the cancellation of the session and all future bookings. The session will last for the remainder of your allotted timeframe; For example, 20 minutes late to 1 hour will leave a remainder of 40 minutes of shoot time. Subject to the photographer’s schedule, time may be extended if there's availability, but please note that an extension is not guaranteed Failure to contact will result in the client being labeled as a no-show, and will be required to pay full payment upfront for any future bookings. 

Failure to Perform

If The Photographer is unable to supply his photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, then the Photographer will attempt to procure the services of another professional photographer to fulfill his obligations. If that does not succeed, the Photographer will return any fees paid by the Client and will have no further liability concerning this Agreement, and the Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.

This limitation of liability will also apply if any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of the Photographer.


Rescheduling

If your event date needs to be rescheduled, due to illness, mechanical breakdown, weather, accidents, or acts of God, We will do everything in our power to work with your new date at no extra charge. If a new date conflicts
with prior bookings, We apologize for the inconvenience but must honor bookings on a first-come, first-serve basis. If we are unable to
re-book your event, due to conflict, the retainer is non-refundable.



Retouching Policy
Here is an included list of what a retouched, edited photo consists of unless otherwise stated.
Color Correction
Skin retouching: (Removing blemishes, Softening skin, Skin Tone Color Correction)
Light body manipulation:  (Slim waist/stomach/arms/chin/neck)
Removal of fly-away hair *extensive hair editing is included in hair or beauty shoot
